1. Acceptance of Terms

By accessing or using any of Flexi Translate's services, including but not limited to our AI instant translation tool, certified human translation services, website, API, and related applications (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not access or use our Services. These Terms apply to all users, including those who are simply browsing our website.

                 Note on Capacity: By agreeing to these Terms, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding contract under Malaysian law.
            

2. Services Overview

Flexi Translate offers two distinct categories of translation services:

2.1 AI Instant Translation Tool (Free Service)

Nature: Fully automated, AI-powered translation of text and uploaded files
Cost: Free for up to 3 translations per anonymous user; unlimited for registered users
Processing: Real-time, ephemeral processing with zero data retention
Languages: 40+ languages supported
Limitations: Maximum 50,000 characters per translation; file size limit 10MB

2.2 Certified Human Translation Services (Paid Service)

Nature: Professional translation by certified human translators
Use Cases: Legal documents, contracts, certificates, business materials, websites, apps
Deliverables: Certified translations with notarization available upon request
Turnaround: Quoted per project based on document length and complexity

                 Service Availability: Our Services are available 24/7 for AI translation. Certified human translation services are available during business hours (Monday-Friday, 10:30AM - 8PM MYT, Saturday-Sunday, 12PM - 6PM MYT).
            

3. User Accounts

To access certain features of our Services, you may be required to create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain the security and confidentiality of your login credentials
Promptly notify us of any unauthorized use of your account
Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws.

Important: You are solely responsible for all activity conducted through your account. Flexi Translate is not liable for any loss or damage arising from unauthorized access to your account.

4. Free Tier Limitations

Our AI Instant Translation tool offers a free tier with the following limitations:

Anonymous users: 3 free translations (count resets daily)
Registered users: Unlimited free translations after account creation
No credit card required for free tier access
Free tier is provided "as-is" without service level guarantees

We reserve the right to modify free tier limits at any time with reasonable notice.

5. Paid Services & Payment Terms

5.1 Pricing

Pricing for certified human translation services is provided via quotation based on:

Document length (word count or page count)
Language pair complexity
Urgency/expedited delivery requirements
Notarization or certification requirements
Specialized subject matter (legal, medical, technical)

5.2 Payment

Full payment is required before commencement of certified translation work
We accept payments via bank transfer, credit card, and e-wallets (as displayed at checkout)
All fees are quoted in Malaysian Ringgit (MYR)
Prices are subject to applicable taxes (including SST where applicable)

5.3 No Refunds

No Refund Policy: Due to the nature of professional translation services, all payments are non-refundable once work has commenced. If we fail to deliver the service as agreed, a pro-rata refund may be issued at our sole discretion.

5.4 Invoicing

We provide official invoices for all paid services. Invoices are sent electronically upon payment completion.

6. Intellectual Property Rights

6.1 Our Intellectual Property

All content on our website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of Flexi Translate Enterprise or its content suppliers and is protected by Malaysian and international copyright laws.

6.2 Your Content

You retain all ownership rights to the content you submit for translation. By submitting content to us, you grant us a limited, non-exclusive, temporary license to process, translate, and return the translated content to you. This license terminates immediately upon delivery of the translated content.

6.3 Translated Content

Upon full payment for certified translation services, you receive ownership of the translated content. For AI instant translations, you own the translated output as a derivative work of your original content.

                 Prohibited Uses: You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any part of our Services without our express written permission.
            

7. Acceptable Use Policy

You agree NOT to use our Services for:

Any illegal purpose or in violation of any laws (including Malaysian laws)
Translating content that is defamatory, obscene, pornographic, or harassing
Translating content that infringes on intellectual property rights of others
Translating classified, state-secret, or similarly restricted information
Attempting to reverse engineer, decompile, or disassemble our software
Interfering with or disrupting the integrity or performance of our Services
Attempting to bypass our free tier limitations
Uploading malware, viruses, or other harmful code

Legal Consequences: Violation of this Acceptable Use Policy may result in immediate termination of your access and may subject you to civil and criminal penalties under Malaysian law, including the Penal Code (Act 574), Communications and Multimedia Act 1998, and Copyright Act 1987.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

AI Translation: Our AI instant translation tool is provided "AS IS" and "AS AVAILABLE" without warranties of accuracy, completeness, or fitness for a particular purpose. AI translations may contain errors and should not be relied upon for legal, medical, or other critical purposes without human verification.
Certified Translation: While we strive for 100% accuracy, we warrant that certified translations are completed by qualified professionals but do not guarantee that any translation will be accepted by any specific government agency or institution.
Service Availability: We do not warrant that our Services will be uninterrupted, error-free, or free of viruses or other harmful components.

                 Limitation of Liability: To the fullest extent permitted by Malaysian law, Flexi Translate's total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you, if any, for the specific service giving rise to the claim. For free services, liability is limited to RM1.
            

9. Indemnification

You agree to indemnify, defend, and hold harmless Flexi Translate Enterprise, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Your use or misuse of our Services
Your violation of these Terms
Your violation of any applicable laws or third-party rights
Any content you submit for translation

10. Termination

By You: You may stop using our Services at any time. For registered accounts, you may request account deletion by contacting our support team.

By Us: We may suspend or terminate your access to our Services immediately without notice for any violation of these Terms, illegal activity, or any other reason at our sole discretion.

Effect of Termination: Upon termination, your right to use our Services ceases immediately. Sections regarding intellectual property, disclaimer of warranties, indemnification, and limitation of liability shall survive termination.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY MALAYSIAN LAW, IN NO EVENT SHALL FLEXI TRANSLATE ENTERPRISE BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from inability to use our Services
Damages related to third-party content or conduct

This limitation applies regardless of the legal theory under which the claim is brought, even if we have been advised of the possibility of such damages.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via:

Email notification to registered users (30 days advance notice for material changes)
Website banner notification (14 days before effective date)

Your continued use of our Services after the effective date constitutes acceptance of the modified Terms.

13. Miscellaneous Provisions

Entire Agreement: These Terms constitute the entire agreement between you and Flexi Translate regarding our Services.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights freely.
Force Majeure: We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control.
